La composizione del nuovo Senato e la sua (ancora) incerta natura

Il contributo ripercorre anzitutto le opzioni di fondo che, in continuità con alcune proposte di riforma avanzate nelle scorse legislature, hanno condotto a configurare una composizione del Senato derivante dall’elezione in seno ai Consigli regionali di consiglieri e sindaci. Si sostiene che si tratta di scelte che sono, come è inevitabile, il frutto di compromessi politici, ma che, nel loro complesso, appaiono abbastanza coerenti. Per poi argomentare nel senso che la partita sulla “vera natura” del Senato sia tutta ancora da giocare, in base a come verranno sciolte, nella fondamentale e delicata fase attuativa, una serie di incognite sulla sua composizione e sulle sue modalità di funzionamento interno. Successivamente, si sottolinea come, inevitabilmente, ogni senatore sarà chiamato ad assicurare “rappresentanze multiple”: del partito, del proprio territorio, della tipologia dell’ente di appartenenza. Quale di questi “cleavage”, in concreto, prevarrà nel nuovo Senato è invero assai difficile da prevedere, anche se il testo costituzionale sembra spingere verso meccanismi che incentivino il rilievo tendenzialmente prevalente del “cleavage” territoriale. In conclusione, dopo essersi soffermati sulle disposizioni transitorie e su alcune loro contraddizioni, si osserva che un ruolo cruciale, forse ancor più di quanto non accada di solito, spetterà al nuovo regolamento del Senato, da approntare quanto prima.

The essay examines the fundamental choices that, in continuity with previous constitutional reform bills, have brought to design the new Senate as composed of regional councillors and mayors. Arguing that these choices are inevitably the outcome of political compromises, it nonetheless points out how overall they appear substantially consistent. The essay further states that the real game on the true nature of the new Senate seems, indeed, yet to be played and its role will depend on the clarification – during the crucial implementing phase – of some important unknowns, regarding its composition and internal functioning. Moreover, it underlines that each senator will be called to ensure multiple representative roles: her/his political party, her/his territory and her/his institutional entity. It is difficult to predict which of those “cleavages” will prevail, however the essay points out that the constitutional bill seems to boost those mechanisms that encourage the relevance and even the prevalence of the territorial one. Finally, after an analysis of some transitional provisions, the essay concludes highlighting that a decisive role, even more relevant than what normally happens, will be played by the new rules of procedures of the Senate, which should be adopted as soon as possible.
