Il presente contributo descrive il percorso di attuazione del regionalismo differenziato ex art. 116, co. 3, Cost. in fieri, e in particolare la determinazione dei LEP, approfondendo le competenze attribuite alla Cabina di regia governativa istituita con la legge di bilancio 2023 e il DDL c.d. “Calderoli”, recentemente approvato dal Consiglio dei ministri, operando altresì un utile raffronto tra l’impianto testé definito e le “pre-intese” del 2018 nonché le successive bozze oggetto di negoziati, nel 2019, fra il Governo e le Regioni Veneto, Lombardia ed Emilia-Romagna.
The essay describes the in fieri implementation process of the differentiated regionalism (pursuant to Article 116 (3) of the Italian Constitution), with a special focus on the definition by the Italian State of the basic levels of services concerning civil and social rights that must be guaranteed throughout the national territory (“LEP”). The Italian Government has recently presented a bill (disegno di legge) on this issue and has also set up a government committee to define the LEP. The analysis on these two government instruments is conducted in light of the requests made in 2018 and 2019 by the regions of Lombardia, Veneto and Emilia-Romagna in the agreements with the Government.
