Il tema della mobilità nel complesso intreccio tra Stato e Regioni: un focus sul trasporto pubblico locale

L’obiettivo del presente lavoro è quello di tentare una ricostruzione coerente del quadro delle competenze regionali nel settore della mobilità con particolare riferimento a porti e aeroporti civili, grandi reti di trasporto e navigazione e trasporto pubblico locale, cercando di tenere conto non solo degli atti legislativi, ma anche dell’interpretazione che al riparto delle competenze tra Stato e Regioni in tale ambito ha dato la giurisprudenza della Corte costituzionale.
Uno specifico approfondimento sul trasporto pubblico locale, anche in termini di comparazione con gli altri Paesi (Spagna, Francia, Germania e Regno Unito), analizza alcuni aspetti gestionali del servizio. Lo scopo è cercare di fornire alcuni elementi informativi in merito all’impatto sul tpl del percorso normativo che ha portato all’attuale riparto delle competenze in tale ambito.
Le possibili prospettive di sviluppo nel settore della mobilità vengono, infine, rappresentate alla luce della nuova domanda di autonomia che il processo di asimmetria ha attivato.

This paper provides a framework of the regional competences in the mobility sector focusing on civil ports and airports, transport and navigation networks and local public transport (tpl), taking into account legislation as well as the interpretation that Constitutional Court has given to the sharing of competencies between the State and the Italian regions in this area.
A specific study on tpl, also comparing Italy with other countries (Spain, France, Germany and the United Kingdom), analyzes some running aspects of the service. The aim is to provide some information on the impact on the system performance produced by the legislation that has led to the current division of competences in this area.
Finally, the possible impact of the proposal for the implementation of a new arrangement of functions between the State and the Regions provided by the asymmetry clause (art. 116 Cost.) on the mobility sector are analyzed.
