The essay examines the Nature Restoration Law and its effects on the systems of the Member States. It highlights issues related to the legal basis adopted, with regard to the objectives pursued and the approximation of legislations. The article also addresses the effects that the restoration framework has at the domestic level of the Member States (and specifically in Italy), in relation to the impact on the distribution of competences between the State and the Regions, as well as the regime of derogations, including in cases of urgency.
Il contributo è dedicato alla disciplina del regolamento sul ripristino della natura e ai suoi effetti sugli ordinamenti degli Stati membri. In esso si pongono in luce questioni relative alla base giuridica adottata, con riguardo agli obiettivi perseguiti e al ravvicinamento delle legislazioni. L’articolo tratta, inoltre, degli effetti che la disciplina sul ripristino spiega sul piano interno degli Stati membri (e, segnatamente, dell’Italia), in relazione all’impatto sul riparto della competenza tra lo Stato e le Regioni e il regime delle deroghe, anche in casi di urgenza.
