The essay examines the governance’s framework of the National Recovery and Resilience Plan included in d.l. 77/2021. Particularly, it studies the role of the Regions in the implementation phase of PNRR and the interweaving of the State and the Regions, as well as the legitimacy of the surrogate powers with the constitutional law. The d.l. “Governance” and d.d.l. Concorrenza highlight the reduced role of the Regions in the transformation of the Italian country, and how them do not allow an assurance of the duty of loyal collaboration and the regional participation.
L’articolo è dedicato alla disciplina della governance del Piano Nazionale di Ripresa e Resilienza recata nel d.l. 77/2021 e si concentra, in particolare, sul ruolo delle Regioni nella fase di attuazione del PNRR, sull’intreccio di competenze tra Stato e Regioni, nonché sulla legittimità della disciplina (speciale) del potere sostitutivo. In esso si pone in luce come il ridotto coinvolgimento delle Regioni nella governance del PNRR non garantisca appieno il rispetto del principio di leale collaborazione e la partecipazione regionale.
