Le “minoranze linguistiche”, non sono una materia, dal momento che non si trovano enumerate nell’art. 117 Cost., bensì sono una nozione costituzionale adoperata dall’art. 6 Cost. e come tale non è nella libera disponibilità del legislatore ordinario (statale o regionale). La “tutela” delle minoranze linguistiche, invece, può porre compiti in capo ai legislatori statale e regionale, la cui concreta realizzazione segue il riparto delle competenze costituzionalmente stabilito.
The “linguistic minorities” are not a subject-matter, since they are not listed in article 117 of the Italian Constitution, but they are a constitutional notion used by article 6 of the Constitution and as such it is not in the free availability of the ordinary legislator (state or regional). The “protection” of linguistic minorities, on the other hand, can place tasks on the part of state and regional legislators, whose concrete implementation follows the constitutionally established division of powers.
